Terms of Use

Effective date: October 20, 2026

These Terms of Use (“Terms”) cover your use of the iPhone and iPad app DesiCards (“DesiCards” or “the app”), made by Hemant Bhonsle, an individual developer in California, United States (“we” or “us”). DesiCards is free. There are no purchases, subscriptions or ads. By downloading, installing, opening or continuing to use DesiCards, you agree to these Terms, our Privacy Policy and Apple’s Standard EULA, including any future updates. If you don’t agree, please stop using the app and delete it.

1. Apple’s Standard EULA

DesiCards is licensed to you under Apple’s Licensed Application End User License Agreement (Standard EULA), which is part of these Terms. If anything in these Terms conflicts with the Standard EULA, the Standard EULA applies, except where these Terms give you more rights. These Terms are between you and the developer, not Apple.

2. Using DesiCards

DesiCards is a conversation game for entertainment. Play kindly: the cards are meant to be fun, so skip any card that isn't right for your group, or remove it with “Not for us”. Masala cards are a little cheekier but always clean, and Family games are always Mild.

3. Price

The app is free to download and use. It has no in-app purchases, subscriptions or advertising.

4. Your suggestions

If you send us a card idea, question, or any other suggestion (a “Suggestion”), by email from the app or any other way, you agree that:

  • The Suggestion is your own original idea, or you otherwise have the right to share it, and it doesn’t copy anyone else’s work or include anyone’s private information.
  • You give us a free, worldwide, permanent, irrevocable and royalty-free right to use your Suggestion however we choose. That includes copying, editing, rewording, translating, combining it with other content, publishing it, and building on it, in DesiCards, in our other apps, in marketing, and in any other product or media, now or in the future. We may also pass these rights on to others.
  • You won’t receive any payment, royalty or other compensation, now or later, for your Suggestion or for anything we make from it.
  • We don’t have to use, reply to, or keep your Suggestion private, and we may already have, or later come up with, similar ideas on our own. You won’t have any claim against us if something similar appears in DesiCards or elsewhere.
  • We may credit you by the name you provide, but we don’t have to, and we may change your Suggestion without asking you. To the extent the law allows, you waive any right to be named as the author or to object to changes.

5. Content and trademarks

The app, its cards and its artwork belong to the developer.

Apple, iPhone, iPad and App Store are trademarks of Apple Inc., registered in the U.S. and other countries.

6. Acceptable use

You agree not to reverse engineer, modify or interfere with the app except as permitted by law, and not to use the app for any unlawful purpose.

7. Disclaimer of warranties

DesiCards, its cards, and its website are provided “as is” and “as available”, without warranties of any kind, express or implied. That includes any warranty of merchantability, fitness for a particular purpose, accuracy, non-infringement, or that the app will be uninterrupted, error-free, or free of harmful components. We do not guarantee that your favorites, decks, or other saved data will never be lost.

8. Limitation of liability

To the fullest extent permitted by law:

  • The developer is not liable for any direct, indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, device problems, hurt feelings, disagreements, embarrassment, or personal, relationship, or financial harm, arising from or related to your use of, or inability to use, DesiCards. This applies whatever the legal theory (contract, negligence, strict liability or otherwise), even if the developer was told such damages were possible.
  • You use DesiCards at your own risk and are responsible for how you play, what you say or share, and choosing cards that suit your group.
  • Card content is for entertainment only and isn’t professional, medical, legal, cultural, or relationship advice.
  • The developer’s total liability for all claims relating to DesiCards is limited to the amount you paid for the app, which is zero.
  • You agree to hold harmless the developer from any claims arising from your use of DesiCards or your breach of these terms.

Some places don’t allow certain warranty exclusions or liability limits, so some of the above may not apply to you. In that case they apply to the fullest extent your local law allows.

9. Changes to these Terms

We may update these Terms at any time. The updated version will be posted on this page with a new effective date. Your continued use of DesiCards after a change means you accept the updated Terms in full.

10. General

These Terms are the entire agreement between you and us about DesiCards. If any part is found unenforceable, the rest stays in effect. If we don’t enforce a part right away, we haven’t given up the right to enforce it later.
